1. What this is about

This policy explains which personal data we process when you visit our website, book accommodation, send us an enquiry or contact us - for what purpose, with which services and for how long. Personal data is any information that can be linked to a person, for example your name, your email address or your IP address.

3. Applicable law

Our business is based in France. The EU General Data Protection Regulation (GDPR) and the French Data Protection Act (Loi Informatique et Libertés) therefore apply. For each section, we state the legal basis under the GDPR.

4. When you visit our website

4.1 Wix

Our website runs on Wix, a website builder. Our contractual partner is Wix Online Platforms Limited in Ireland, part of the Wix.com group based in Israel. With every visit, Wix records technically necessary information: IP address, date and time, the page visited, browser and operating system, and the page you came from. This is needed to display the website, keep it secure and detect errors. For error monitoring, Wix uses the service Sentry (Functional Software, Inc., USA). Wix stores data in its own data centres and with subcontractors, including in the USA and Ireland. Wix delivers the website's fonts from its own servers.

Legal basis: legitimate interest in a secure, functioning website (Art. 6(1)(f) GDPR).

4.2 Cookies and consent

On your first visit, a cookie banner appears. Wix always sets necessary cookies, for example for security and to save your choice in the banner. Everything else, in particular visitor analytics (section 4.3), only runs if you agree. If you decline, none of it is loaded. You can change your choice at any time using the "Cookie Settings" button at the bottom left of every page, or delete cookies in your browser.

Legal basis: necessary cookies on the basis of legitimate interests (Art. 6(1)(f) GDPR), all others only with your consent (Art. 6(1)(a) GDPR, Art. 82 Loi Informatique et Libertés).

4.3 Visitor statistics

We would like to know which pages are read so that we can improve the website. For this we use two tools, both of which only run if you agree in the cookie banner:

Wix Analytics: the built-in statistics from Wix (page views, sources, devices).
Google Analytics: a service of Google Ireland Limited (Ireland), with processing also by Google LLC in the USA. Google Analytics shows us how visitors find our website and which pages they view. Cookies are set; Google Analytics does not store your IP address.

We only evaluate this information in aggregate and do not try to identify individual visitors.

Legal basis: consent (Art. 6(1)(a) GDPR), which you can withdraw at any time via the cookie settings.

4.4 Google reviews

On our home page and our weddings page, a small badge shows the rating guests have given us on Google. It is provided by a third-party Wix app ("Google Reviews"). The app's script is loaded on every page from servers in the USA (DigitalOcean), the reviews are retrieved via Google Cloud (USA), and the badge loads its font from Google Fonts (Google Ireland Limited, with processing also in the USA). Your IP address is transmitted to these servers in the process, also before you make a choice in the cookie banner.

Legal basis: legitimate interest in showing genuine guest reviews (Art. 6(1)(f) GDPR).

5. When you book accommodation

Our accommodation can be booked directly on the website. The booking system is provided by Wix (Wix Hotels). When you book, you provide your name, email address, phone number, travel dates, number of guests and, if you wish, a message. Your booking is stored in our Wix account, and you receive a confirmation by email.

Payment: you pay the full amount online when you book, via PayPal (PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg). You enter your payment details only with PayPal; we cannot see them.

We also offer our accommodation on booking portals. Availability and bookings are kept in sync by the channel manager HotelRunner (HOTELRUNNER, INC., USA, together with its group companies). If you book through a booking portal, its privacy policy also applies, and we receive your booking data from the portal via HotelRunner.

Legal basis: contract and pre-contractual enquiry (Art. 6(1)(b) GDPR), legal obligations such as accounting (Art. 6(1)(c) GDPR).

6. Contact form

On the contact page, you can write to us using a form. You provide your name, your email address, the type of enquiry and your message, and optionally your phone number, the approximate number of guests and your preferred date. The form is provided by Wix (Wix Forms); your details are stored in our Wix account and sent to us by email. We only use them to answer your enquiry.

Legal basis: your enquiry before a possible booking (Art. 6(1)(b) GDPR), otherwise legitimate interest in answering it (Art. 6(1)(f) GDPR).

7. When you email or call us

Many buttons on our website open your email program with a prepared message to info@chateaudestinee.com, for example to book a dinner or an event. If you send us an email or call us, we process your details in order to reply and to handle your booking. Our mailbox is hosted by Google Workspace (Google Ireland Limited, Ireland, with processing also in the USA).

Legal basis: your enquiry or our contract (Art. 6(1)(b) GDPR), otherwise legitimate interest in answering it (Art. 6(1)(f) GDPR).

8. Links to other websites

Our website contains links to Google Maps, Facebook, Instagram, LinkedIn, our Google reviews, our crowdfunding page on onparticipe.fr and the websites of photographers. These are ordinary links; nothing from these services is loaded into the page. Only when you click on them are you taken to the respective service, where its privacy policy applies.

9. Technical support for the website

Our website is designed and technically supported by SwissMade WebDesign GmbH (Switzerland). For this purpose, it has access to our Wix account. It processes your data only on our behalf and only as far as necessary for these tasks.

11. Transfers to countries outside the EU

Some of these services process data outside the EU. For Israel and Switzerland, the European Commission has recognised an adequate level of data protection. For providers in the USA, we rely on their certification under the EU-US Data Privacy Framework where available, otherwise on the European Commission's standard contractual clauses used by the provider.

12. How long we keep data

Server and security data: as long as Wix needs it for operation.
Visitor statistics: Google Analytics keeps data linked to a cookie for 14 months after your last visit, individual events for 2 months.
Bookings and invoices: ten years, as required by French commercial law.
Enquiries without a booking: until the enquiry has been dealt with, at the latest three years after the last contact.

13. Your rights

You can ask at any time which data we process about you. You can ask us to correct inaccurate data, delete data or restrict its processing, and you can object to processing. On request, you will receive the data you have provided to us in a common format. You can withdraw consent at any time; this applies from then on and not retroactively. You can also give instructions on what should happen to your data after your death (Art. 85 Loi Informatique et Libertés). Statutory retention obligations remain unaffected.

To do so, please write to us at info@chateaudestinee.com. To make sure the request comes from you, we may ask for confirmation.

If you are not satisfied with our reply, you can lodge a complaint with the French data protection authority: Commission Nationale de l'Informatique et des Libertés (CNIL), 3 Place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, France, www.cnil.fr. You can also contact the data protection authority in your country of residence.

14. Security

The website is encrypted (https). Our accounts are protected with secure passwords and, where possible, two-factor authentication. Risks on the internet can never be ruled out completely, for example with unencrypted emails.

We update this privacy policy when something changes on our website, in the tools we use or in the law. The version published here applies.
